1. Agreement to these terms
These Terms of Service (“Terms”) are a legal agreement between you and Send A Fart (“Send A Fart,” “we,” “us,” or “our”) governing your use of the Send A Fart mobile app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.
2. Who can use the Service
You must be at least 13 years old to use Send A Fart. If you are under the age of majority where you live, you may only use the Service with the involvement and permission of a parent or guardian, who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that the information you give us is accurate.
3. Your account
You sign in with your phone number, and we may verify it. You're responsible for keeping access to your account secure and for activity that happens under it. Keep your account information accurate, and let us know at support@sendafart.app if you believe your account has been compromised. One person per account; don't impersonate anyone or use someone else's number without permission.
4. Acceptable use
Send A Fart is for sending silly fart sounds to friends. It is not for harming, harassing, or deceiving people. You agree not to:
- Harass, bully, threaten, or target anyone, or send farts to people who don't want them from you (that's what blocking is for — respect it).
- Record or upload audio that is illegal, hateful, sexually explicit, or that infringes someone else's rights, or that isn't yours to share.
- Spam, flood, or abuse the sending or notification features to disrupt or annoy beyond the good-natured spirit of the app.
- Break the law, violate anyone's privacy, or record people without the consent you're legally required to have.
- Reverse-engineer, scrape, overload, or interfere with the Service, or try to access accounts or data that aren't yours.
- Use bots or automated means to create accounts or send farts.
We provide report and block tools on content, backed by real moderation. We may remove content, and suspend or terminate accounts, that violate these Terms or that we reasonably believe are harmful, at our discretion.
5. Your content and recordings
You keep ownership of the audio you record and the content you create (“Your Content”). To run the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and transmit Your Content for the purpose of operating and improving the Service — including delivering it to the friends you send it to and generating shareable fart cards. This license ends when you delete Your Content or your account, except for content already shared with others or copies retained in routine backups for a limited time.
You're responsible for Your Content and confirm you have the rights to share it. Shared fart cards are accessible to anyone who has the link and can be played in a web browser, so only share what you're comfortable being seen and heard.
6. Fart Pass, purchases, and billing
The core app is free. The Fart Pass is an optional one-time purchase (currently $2.99) that unlocks premium features for the life of your account, and we also offer one-time sound packs. Purchases are made through and billed by the Apple App Store or Google Play, subject to their terms.
- One-time purchase: the Fart Pass is a single purchase, not a subscription — there's nothing that auto-renews and nothing to cancel. It stays with your account.
- Refunds: payments are handled by the app stores, so refund requests are subject to Apple's or Google's policies. Except where required by law or store policy, purchases are non-refundable.
- Price changes: we may change the price of the Fart Pass or sound packs going forward; a change won't affect a purchase you've already made.
- Sound packs: one-time purchases unlock the associated sounds for your account.
7. Ads
The free tier is supported by ads served through third-party networks. By using the free tier you agree to see them. The Fart Pass removes ads. See our Privacy Policy for how advertising data is handled.
8. Our intellectual property
The Service itself — including the app, the curated sound library, the “Send A Fart” name and logo, and the Whoopee Arcade look and feel — belongs to us and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. Don't copy, resell, or misuse it, and don't use our branding without permission.
9. Third-party services
The Service relies on third parties (such as the app stores, hosting and notification providers, and ad networks). We're not responsible for third-party services, and your use of them may be governed by their own terms.
10. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or create risk or legal exposure for us or other users. Sections that by their nature should survive termination — such as content licenses already granted, disclaimers, and limitations of liability — will continue to apply.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Service will be uninterrupted, error-free, or that a fart will always arrive on time. It's a fart app — use it for fun, and use good judgment about when and where sounds play out loud.
12. Limitation of liability
To the fullest extent permitted by law, Send A Fart and its team won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or US $50.
13. Indemnification
You agree to indemnify and hold Send A Fart harmless from claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or the rights of others.
14. Governing law and disputes
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Georgia will have exclusive jurisdiction over any dispute that isn't otherwise resolved, except where applicable law gives you the right to bring a claim elsewhere.
15. Changes to these terms
We may update these Terms from time to time. When we make material changes, we'll update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after an update means you accept the revised Terms.
